POLICIES

What are your general ordering policies?

First, please read the following:

All products in the Blowfish Catalog are available for sale only to those 18 years of age or older, regardless of where you live, or what you are ordering.

By placing any order with Blowfish, via any means (written, oral, electronic, or otherwise), you certify that you are 18 years of age or older, that this material does not violate the community standards of the area in which you live, and that you will immediately return any material which you feel might violate those standards to Blowfish for a full refund.

Blowfish never knowingly sells any product that is not legal for sale to adults in the United States.

We will be happy to answer any questions you may have about this policy.


What are your privacy policies?

Due to the nature of the products we sell, and because we believe that privacy and trust are essential to good business, we have a strict privacy policy. Here it is. If you have any questions or concerns about it, do not hesitate to contact us at privacy@blowfish.com. This privacy policy applies to all information collected by Blowfish, whether via the Internet or otherwise.

We do not share, rent, sell or trade any personal information with any outside organization. We do not rent our mailing list, either paper or electronic, nor do we allow others access to it for any reason. Any information given to Blowfish is used only for the specific purposes for which you supply it to us.

We do not "spam," or send unsolicited email advertisements. We do send a weekly email newsletter, which is strictly opt-in. If you are receiving it, and wish to be removed, write to remove@blowfish.com and you will be taken off; if that doesn't work for any reason, write to human@blowfish.com and a staff member will remove you manually.

We do send paper catalogs to customers; by default they're sent to the billing address. You can request to not be placed on our paper catalog mailing list when you place your order. You can also request that the catalog be mailed to an address other than your billing address. If you wish to be removed from our paper catalog mailing list, please send your name and address to catalog@blowfish.com, and you will be removed from our next mailing. Given the lead times in our catalog mailings, there's a chance that you will receive one more catalog if we had already sent out the mailing before you requested that your name be removed from the mailing list.

The bulk mail indicia (the area where a postage stamp would be placed on a first class letter) on our catalog mailing envelopes requires that we use our bulk mail permit code so that box does include the word Blowfish.

If you charge your order, our charge will appear on your credit card bill with the company name "The Blowfish Corporation."

We do not do any telephone solicitations, nor do we share, rent, sell or trade telephone numbers. We will only call you if we have a question or problem about your order. If you are not available when we call, we will be as discreet as possible in leaving any message; we will only say that The Blowfish Corporation is calling with a question or problem about your order.

We may contact the holder of a credit card used on an order at the billing address or telephone numbers supplied, or at those supplied by the credit card holder's bank, to verify the legitimacy of an order.

All orders are shipped with a receipt which indicates the name and address of the purchaser. If you mark the order as a gift, we will instead enclose a packing slip which also indicates the name and address of the purchaser but does not list product prices; the receipt with full pricing information will be sent you at the billing address. On all international Expedited orders, a receipt for the shipping is sent to the billing address, even if the shipment is mailed elsewhere.

We do place cookies in your browser. The functions of these cookies are to keep track of your shopping cart and to analyze the path that users take through our site, so that we can constantly improve our site navigation system. No personal information is placed in it. You do not have to accept these cookies to use our site. You do need to accept these cookies to use our on-line shopping cart system. You do not need use our on-line shopping cart system to order; we accept orders by telephone, fax, paper mail and email as well as over the Web.

We log the IP address of access to our web site. This information is used for general performance monitoring and analysis, and in rare cases to track down the source of abuses of our site.

We retain records of orders, including customer addresses and payment information (including credit card numbers), to permit resolution of disputes and questions, and to provide accounting records. These records are kept confidential, and are not shared with any other outside party except as required by law, to resolve billing and credit card disputes, or when authorized by the customer whose records they are.

Any paperwork containing customer names, addresses, or other information is destroyed before being disposed of.

In the normal course of business, we do supply limited customer information to outside vendors. For example, in order to ship via the United States Postal Service or United Parcel Service, we have to give them your address; similarly, in order to place a charge on your credit card, we have to give the credit card number to our credit card processing company. We also have to give your name and address to any vendor who is drop-shipping your order directly to you. We do not give these vendors any more information than is required to complete the actual business purpose at hand.

All shipments sent to addresses in the United States are packaged in generic wrapping, without an indication on the outside of the parcel as to what the contents are. The return address on the packages is:

Shipments sent to international addresses (those outside of the United States) have the legally-required customs tags. We use generic, not-sexually-related descriptions on these tags ("Books," "Prerecorded videotapes"). Note that customs officials of any country are authorized to, and sometimes do, open any package and inspect the contents. We cannot accept responsibility for any orders confiscated or seized by foreign customs or governments, and all import duties, tariffs and taxes are the responsibility of the customer.

What is your return policy?

We hope that everything you get from Blowfish is something that you will treasure forever ... but sometimes things go wrong. Here is our return policy. Please feel free to contact us at service@blowfish.com if you have any questions. Please contact us at service@blowfish.com if you have any questions about a product, or wish to arrange a return.

Because we cannot resell most of our products once they are shipped from us, even if the packaging is unopened, we are unable to do exchanges. All exchanges are treated as a return (per the above policy) and a replacement order.

Orders which are refused, or which are returned to us undelivered when shipped to the customer-supplied shipping address, will be treated as a satisfaction return.


Is there anything special I need to know about ordering videotapes or DVDs?

The box covers pictured in our catalog are not always the box covers on the videos or DVDs we ship (although they usually are). Distributors sometimes ship us videos and DVDs in different, or even plain, box covers. We cannot accommodate special requests regarding packaging; your video or DVD will be shipped in whatever packaging we have in stock at the time.

Whenever possible, we carry the unedited versions of our videos and DVDs. However, due to changes over the years in laws and law enforcement regarding erotic material, some videos are not available through our distributors in their original form. This is especially true with older titles (i.e., ones made before about 1985); material which was generally considered legal at the time of production has been edited out of some tapes, in an attempt to comply with the vague patchwork of laws regarding sexually explicit art. Unfortunately, we don't always know which videos have been edited, since the versions we review tend to be the ones currently available.

Some of the videos we sell have not had their recording protection tabs removed, and we aren't able to check every tape we receive to see if the tabs are still there. We therefore strongly advise you to check the tapes you receive, and remove the tabs if they haven't already been removed, so you don't accidentally record over your videos. Blowfish will not be responsible for replacing videotapes which customers accidentally record over.

Foreign customers please note: If you are ordering videos we are unable to obtain or sell videotapes in any format except VHS-NTSC. NTSC is the video standard in the United States, Canada, and Japan, but not in the UK or Europe. Unless you have a videotape player which can play NTSC format, you will be unable to play the tapes we sell. In addition, we cannot guarantee the country compatibility of any of our DVDs. Although all of our DVDs will work within the United States, and we have not yet had a report of any of our DVDs not working outside the United States, the DVD distributors do not inform us if any DVD has been encoded with country restrictions.


What is your order cancellation policy?

If an order has not yet entered the shipping process (which begins when we release an order to our warehouse or to the product vendor for a drop-shipment), it may be cancelled with no penalty. We may charge a 15% restocking fee for cancellations of special-order items, even if they have not yet entered the shipping process.

Once an order has entered the shipping process, we will attempt to cancel it, but we cannot guarantee that we can intercept the order before it ships. If we do intercept the order, we will cancel it with no penalty except as noted above.

If an order has been shipped, cancellations are covered by our satisfaction return policy.


Anything I should know about pricing?

While we make every effort to ensure that all of the prices on our site are accurate, sometimes pricing mistakes might occur. Price and availability are subject to change without notice. Prices are not final until the order is shipped.


PRODUCTS

What sizing standards do you have for toys?

Because various manufacturers use various standards for the size of toys, we have adopted a consistent standard for all the toys we sell: The length of a toy is always the maximum insertable length of the toy (not including a base, flange, or flare at the bottom). The width of the toy is the maximum width of the toy in the insertable portion.

Sizes on silicone and acrylic toys can vary by as much as 1/4" from the nominal size, in both the width and the length. If size is very critical in these toys, it's a good idea to get a toy 1/2" smaller than your absolute maximum size. For other toys, the size can vary by as much as 1/8".

Toys that are within those size tolerances won't be accepted by as defective for being off-size.

What current do your plug-in vibrators require?

Unless otherwise noted in the product description, all of our plug-in vibrators are designed to run on 60 Hz, 110-120 volt AC current, which is the standard line (or "mains") current in the United States. Because of the danger of fire, the risk to the customer, and distributor's restrictions, we do not sell any device that uses line current outside of the United States.

(Note, however, that most of the world uses 50 Hz, 220 volt line current, and that will immediately damage or destroy any plug-in vibrator designed for US-style current. Travel adapters and transformers will not protect these toys from damage. Damage due to using these toys with the wrong line current will void the warranty, and is not eligible for repair or replacement under our defective-return policy.)


ORDERING

How do I order on-line?

Our on-line ordering system is the fastest and most convenient way to order from us.

The system is based on a "shopping cart" of products. To add a product to your shopping cart, just click on its price (the price will probably look something like $19.95); this will put it in your shopping cart. You can add and remove items from your shopping cart at any time. The system will automatically adjust the shipping and handling, and sales tax, as you add and remove items.

When you are ready to place your order, just click on the appropriate button on the shopping cart page, and the system will step you through the questions needed to place your order. You can enter your credit card into a secure server, or send it to us separately if you prefer.

You can also place your order using our on-line system, and then pay by check or money order. The confirmation page and email will give you instructions on how and where to send your payment.

To go to your shopping cart at any time (or to pick one up if you don't have one already), you can click on the "Shopping" icon at the top and bottom of each page (it's a shopping cart).

When you get your shopping cart, you'll get a shopping cart ID. This looks something like a license plate number: a digit and three letters, followed by four digits (like 5ABC1234). Make a note of it; if you quit out of your browser, or your computer crashes, or something else, you can get back to your shopping cart from here.

How do I place an order if I don't want to order on-line?

We are happy to accept phone orders in addition to web orders.

Our phone number for orders is (800) 325-2569 ... this number is for orders only, thanks. Please have both the item numbers and the item descriptions (very very important!) when you call. Our phones are staffed from 10am to 5pm Pacific Time.

If you can place your order through the web shopping cart system but do not want to give us your credit card number through the web, you can mark the radio button for whatever credit card you plan to use in the first Payment Method section, then use the checkbox that says "Check here if you wish to submit your credit card number off-line" on the page where you give us your billing and shipping information. This will allow you to complete the shopping cart, sending us a pending order. Please write down your shopping cart number! Then you can contact us separately by fax or phone to give us your credit card information so we can complete the order. Do not email your credit card number to us.


How do I place an order if I don't want to order on-line and I don't live in the U.S.?

We are happy to accept phone orders in addition to web orders.

Our phone number for orders from overseas is +1 415 252 4340. Please have both the item numbers and the item names (very very important!) when you call. Our phones are staffed from 10am to 5pm Pacific Time (that's between 7 and 8 hours behind Greenwich Mean Time).

If you can place your order through the web shopping cart system but do not want to give us your credit card number through the web, you can mark the radio button for whatever credit card you plan to use in the first Payment Method section, then use the checkbox that says "Check here if you wish to submit your credit card number off-line" on the page where you give us your billing and shipping information. PAYMENT

How can I pay for an order?

For orders shipped to the United States, we accept VISA, MasterCard, American Express and Discover Card. We also accept money orders, and personal and company checks if imprinted with your full name and address, and made out in U.S. dollars and drawn on a U.S. bank.

There will be a hold on all orders paid for by a personal or company check. Holds may apply to large or unrecognized money orders.

For orders to any foreign country, we can only accept credit cards for payment.

Orders billed to any credit card must include the correct billing address for the credit card, even if the order is being shipped elsewhere.

Sorry, we cannot ship COD. We cannot accept orders for delayed payment ("please don't run my credit card until this date"); if this is a concern, please wait until we can process your payment to place the order.

We generally do not charge your credit card until your order is ready to ship. Exceptions include special order items, orders shipped to a foreign address, and orders which are scheduled for delayed delivery; those orders are charged when the order is entered into our system.

We charge $20 for any check returned by your bank to us unpaid, in addition to the face value of the check. All returned checks are immediately placed with a collection agency, so please don't bounce a check on us, thanks.


Do I have to pay tax on my order?

We must charge local sales tax on all orders shipped to California addresses; please add it on to the appropriate spot on the order form (the on-line order system does it for you). California sales tax is not charged on shipping.

Note to foreign customers: You may have to pay import duties and or other charges (including GST/VAT) on your purchases. These are assessed and charged by your government's customs authorities, not by us, and those charges are not included in the prices shown.


How do discounts and sales work?

We have sales from time to time -- some sales apply to just about everything we carry, and some apply only to certain types of products.

All discounts and sales are subject to the following limitations:

Special note on packages, combination deals, and special sale prices: Many packages, combination deals and sale prices require that a group of items be bought. If one of the items is returned such that the package, combination deal or sale no longer applies, the overall cost of the order will be adjusted appropriately, and any additional amount due will be deducted from the refund issued to the customer.


SHIPPING

Can I have my order shipped to my hotel (or other temporary location)?

Orders to hotels or other temporary locations must be verified by phone. Once the order is placed, please contact us to verify the order. If an order to a temporary address is returned, we will have to strictly enforce our returned-order policy.


Can the package be left even if I don't answer the door?

If you have special delivery concerns such as "do not leave with neighbor", "dlvr to mgr'if no answer", etc., in most cases we will be happy to note it on the package, however, the delivery person makes the final decision about whether or not to leave a package. (We can only handle delivery notes of 28 characters or less.)

High value packages will always require a signature for release. Other packages may also require signature. Please contact us before ordering if you have any concern about your ability to sign for a package or any other special addressing or delivery concerns.


What are your shipping times and prices within the U.S.?

We ship all orders as fast as we possibly can. Due to backorders from our many vendors, items can occasionally run out of stock and become backordered. See the Time-in-Transit and Backorders section below for details.

We offer three types of shipping within the U.S.: Standard, Expedited (2nd day shipping service), and Express (next day shipping service). Alaska and Hawaii have higher rates for all types of shipping and have their own price chart below.

Note that all orders are processed Monday through Friday, first-come, first-served within our warehouse; faster shipping gets the order to you faster once it leaves us. Express and Expedited orders will not be delivered on Saturday or Sunday. Express orders will arrive one working day after the day we ship. Expedited orders will arrive two working days after the day we ship. Standard shipping times vary greatly depending on carrier and distance from us to you, but most Standard shipments are delivered within 3-7 days after the shipment leaves our warehouse.

We offer free standard shipping on orders of $100 or more going to any address in the United States, including Alaska, Hawaii, US Territories, and APO/FPO addresses. Only products on which shipping is normally charged count towards the $100 for free shipping. In particular, Sex Cushions, Gift Certificates, and other products on which shipping is normally free do not count towards the $100 for free shipping.

Orders of $100 or more must be shipped to a street address.

Orders going to APO/FPO Boxes and U.S. Territories and Possessions (Puerto Rico, American Samoa, Federated States of Micronesia, Guam, Marshall Islands, Commonwealth of the Northern Mariana Islands, Republic of Palau, and the U.S. Virgin Islands) must be sent by US Postal Service only. Standard shipments will be Priority Mail, First Class Mail, or Media Mail. You can also choose Express shipping, which will be by Express Mail (see the chart below for pricing). Please note that our online system will show you Expedited shipping even though it is not available to these addresses. If you choose Expedited shipping, when your order arrives in our offices your shipment will automatically be changed to Express shipping and you will be charged the appropriate price from the chart below.

Express Mail is generally delivered one delivery day after leaving our warehouse, but the Post Office does not guarantee overnight delivery to all locations. APO/FPO addresses will always take longer than regular mail due to the way military mail is handled, but choosing Express shipping will get your package into the military mail stream faster than Standard shipping.

Also note that all APO/FPO shipments, including Express Mail shipments, and Express Mail shipments to U.S. Territories and Possessions, are sent out one day a week only due to the extra paperwork required for those shipments.

Special rules apply to high value orders going to APO/FPO addresses and addresses in the U.S. Territories and Possessions; contact us for details. All high value orders must be signed for by an adult upon receipt. Sorry, we cannot waive this requirement. Multiple orders placed on or about the same time are combined when considering all limits on shipping.


What are your shipping times and prices outside the U.S.?

Please note that, while everything that Blowfish sells is legal to sell in the U.S., foreign governments and customs authorities can have different, and sometimes arbitrary, ideas of what is legal to import. We cannot accept responsibility for any orders confiscated or seized by foreign customs or governments, and all import duties, tariffs and taxes are the responsibility of the customer. Before you read the rest of this section, please note that orders going to U.S. military employees who are stationed outside the U.S. and receive their mail through APO/FPO Boxes and orders going to U.S. Territories and Possessions (Puerto Rico, American Samoa, Federated States of Micronesia, Guam, Marshall Islands, Commonwealth of the Northern Mariana Islands, Republic of Palau, and the U.S. Virgin Islands) are processed as domestic orders. Please read the domestic shipping information (above) and make sure that you use the domestic order form (do not enter your country name on the first shopping cart shipping & payment page or else you'll get the international order form).

We offer two shipment methods for international orders: Standard (10-25 days, economical); Expedited (8-15 days, expensive). We generally recommend Standard for smaller orders, and Expedited for orders over US$100. All orders valued at $250 or more must go by Expedited method and can only be delivered to street address (no post office boxes). All orders over $500 will be split into multiple shipments and you will be charged the actual cost of each shipment.

If you choose Standard you will be charged shipping according to the table below. This shipping/handling fee will be charged along with your product costs.

If you choose Expedited, we will charge your credit card for the precise amount the carrier charges us whenyour order ships; thus, you'll see two charges on your bill for each order (or more, if we have to split the order, as mentioned above). We cannot tell you through our online system what your exact shipping charge will be but you can see our chart below with estimated shipping fees. You will see a charge ($5.50) on your online order summary that is a handling and documentation fee; this covers processing of extra customs documents required for Expedited shipments. Also note: Express Mail packages to foreign countries can only be delivered to street addresses. Do not give us a post office box number for an Express Mail package; we will just have to delay your order while we ask you for a street address instead.

To give a basis for comparison, here are some example Expedited shipping costs. These costs are based on a 3 pound package, which is around 2-3 videotapes or 4 paperback books. This table is not a quotation, since the precise weight and fees can vary.

We do not make partial shipments on international orders (unless they must be split up, see above); we wait until the entire order is complete.

International shipments go out only once a week due to the extra paperwork required for all international shipments. All delivery times are from the time the merchandise leaves us, and are (highly) approximate. We cannot be held responsible for the acts or omissions of any government, up to and including seizure of your shipment.

Are there any other shipping charges I should know about?

Please be sure that your shipping address is correct. We may have to charge you for returned or redirected shipments, or changed addresses, if the carrier charges us.

Orders which are refused, or which are returned to us undelivered when shipped to the customer-supplied shipping address, will be treated as a satisfaction return.


How soon can I expect my order to arrive?

We ship all orders as fast as we possibly can, but products can occasionally become back-ordered. If you have any questions about your order, please feel free to contact us at service@blowfish.com.

For domestic orders, if we choose to make a partial shipment of your order due to a back-order, we will not charge you shipping when we ship the remainder of the order. When this happens, Expedited or Express shipments are only shipped Expedited or Express for their first shipment; subsequent portions go via Standard shipment means. You may contact us to pay for Expedited or Express shipping on the remaining items on a partially shipped order if you wish.

Foreign orders valued at over $500.00 will be split into multiple shipments and you will be charged the actual shipping for each package. We do not normally partial ship international orders under $500.00, but if we do, you will be charged the actual shipping fee for each shipment. Please send an email to service@blowfish.com if you absolutely do not want your order valued at under $500.00 split into multiple shipments (don't forget to include your shopping cart number in the email!).

If your order must arrive by a particular date, please let us know, and we'll do our best to accommodate it. Due to supplier's delays, we cannot guarantee delivery by a particular date, even with expedited service.
